CallBeagle Terms of Service
Draft — not yet in effect. This page is a working draft published for review. It is not a binding agreement and has not been reviewed by a lawyer. Until a final version is published here with an effective date, early-access use of CallBeagle is governed by your agreement with ClickBeagle. Questions: hello@clickbeagle.com.
Status: draft for review. Not yet in effect. No effective date.
1. The service
CallBeagle is the call-tracking part of ClickBeagle: tracking phone numbers, call forwarding to numbers you choose, optional call recording and transcription, call reports, and delivery of call conversions to tools you connect. Phone numbers are US local numbers provided through our carrier partner.
2. Your responsibilities
You are responsible for how you use tracking numbers, call recording and the data the service collects, including:
- Recording disclosure and consent. You decide whether calls are recorded (off by default). If you turn recording on, you are responsible for complying with every federal and state law on recording and monitoring calls, including all-party (two-party) consent laws in states such as California, Florida, Illinois, Maryland, Massachusetts, Montana, New Hampshire, Pennsylvania and Washington. When recording is on, callers hear a short disclosure before recording starts; that disclosure may not be enough for your use, and you remain responsible for obtaining any consent the law requires.
- Telemarketing and messaging laws. You are responsible for complying with the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, state telemarketing and mini-TCPA laws, and do-not-call rules for any calls or texts you make or cause to be made. Tracking numbers are for receiving calls; outbound calling and texting are not offered.
- Forwarding numbers. You may only forward calls to numbers you own or are authorized to use, and you must verify them when asked.
- Your site and your notices. You are responsible for telling your visitors, in your own privacy notice, that you use call tracking and session analytics, and for any consent your visitors must give.
- Accounts and access. You control who in your organization can listen to recordings and see caller details, and you keep your sign-in credentials secure.
3. Not for emergency calls (no 911)
CallBeagle is not a telephone service for emergencies. Tracking numbers only receive and forward calls to your business. They cannot be used to call 911 or any other emergency number, do not provide your location to emergency services, and are not a replacement for a phone line that can reach emergency services. Do not advertise a tracking number as an emergency number.
4. Phone numbers and carriers
- Phone numbers are provided by our carrier partner and remain subject to carrier and regulatory rules. Numbers are not portable out until porting is offered, and a number you release may be reassigned after a cooling-off period of at least 30 days.
- Carriers may label, filter or block calls (for example “Spam Likely”) under rules we do not control, including STIR/SHAKEN call authentication. We do not guarantee that every call will be delivered or labeled correctly.
- Call quality, delivery and availability depend on carriers and networks. Calls may be dropped, delayed or sent to voicemail when a forwarding number is not verified, outside business hours, or when platform safety limits are reached.
- Text messages to tracking numbers are received only. Sending texts would require carrier registration (such as A2P 10DLC) that is not in place.
5. Fees and usage
Plans include a number of tracking numbers and call minutes per month. Usage above the plan is billed per number and per minute at the published prices. You see your usage in your account, and we warn you at 80% and 100% of what your plan includes. Spam calls that are blocked or that you mark as spam do not count toward your minutes. During early access there is no CallBeagle platform fee; carrier costs are agreed with you before any number is bought.
6. Data and privacy
How we handle call data is described in the call-tracking privacy addendum and the ClickBeagle privacy policy. Where we process personal data on your behalf, the data processing terms apply.
7. Acceptable use
You must follow the Acceptable Use Policy. We may suspend numbers or accounts that break it, that put the network or other customers at risk, or when a carrier or regulator requires it.
8. Disclaimers and limits
The service is provided “as is”. To the extent the law allows, we are not liable for lost calls, lost leads, carrier actions, or indirect or consequential damages, and our total liability is limited to the fees you paid for CallBeagle in the three months before the claim. Final wording of this section is subject to legal review.
9. Changes
We will publish the final version of these terms, with an effective date, before billing for CallBeagle starts, and give notice of later material changes.
